Headnote

appearing in a claim, in which the non-technical features may even form a
dominating part of the claimed subject matter. Novelty and inventive step,
however, can be based only on technical features, which thus have to be clearly

with the technical subject matter of the claim for solving a technical problem, i.e.

18. Claim 1 of the main request defines a method for estimating sales activity of a
product at a (non-reporting) sales outlet. The estimated sales activity is calculated
essentially by correlating sales activities at reporting sales outlets according to
the respective distance between the non-reporting sales outlet and the respective
reporting sales outlet (see claim 1 and the WO publication, page 4, lines 33 ff.
and page 8, lines 3 to 36, for example). Such a method is not an invention within
the meaning of Article 52(1) to (3) EPC
22. Auxiliary request 1 explicitly claims technical means (processor) to perform
individual steps of the method. From the HITACHI decision T 258/03 (supra),
Reasons Nos. 4.1 to 4.7, it follows that the claimed method is an invention in

Zu Merkmal 5.1 bis 5.3:
Der Patentanspruch lehrt damit, dem Benutzer optisch anzuzeigen, dass er dem Rechner
mit der Bewegung einen Befehl gegeben hat, der die Entsperrung bewirken kann, und sie
tatsächlich bewirkt, wenn die Bewegung des Benutzers den (Mindest-)Anforderungen an
die vorgegebene (Finger-)Bewegung entspricht.
Der in der Fingerbewegung liegende Steuerbefehl soll mit anderen Worten nicht nur die
Entsperrung, sondern auch eine den Befehl und den Fortgang seiner Ausführung
symbolisierende Anzeige auslösen. Dies ist eine technische Lösung des technischen
Problems, dem Benutzer den Entsperrvorgang optisch kenntlich zu machen und damit die
Bedienungssicherheit zu erhöhen.

Zu Merkmal 5.4 bis 5.5:
Hingegen betrifft die Anweisung, diese Anzeige als Bewegung eines Entsperrbildes entlang
eines angezeigten Pfades auf dem Bildschirm auszuführen, die inhaltliche Ausgestaltung
der mit graphischen Mitteln gegebenen Information. Die Bewegung des Entsperrbildes
imitiert die Steuerbewegung des Nutzers und macht damit die Einleitung und den Fortgang
(oder den Abbruch) der durch diese bewirkten Entsperrung besonders anschaulich.
Damit wird aber allein dem menschlichen Vorstellungsvermögen Rechnung getragen,
weswegen das Patentgericht zu Recht in Anführungszeichen von einem Verschieben des
Entsperrbildes gesprochen und der in den Merkmalen 5.4 und 5.5. angesprochenen Inter-
aktivität keinen über die Merkmale 5.1 bis 5.3 hinausgehenden Inhalt beigemessen hat.

Patentanspruch 1 betrifft ein Verfahren, bei dem Bilder empfangen,

2.1.5 … The appellant has argued that the reduction in the use of computer resources
explained above is the required additional technical effect in the present case. The
appellant further argues that any layout improvement which has the effect of "lowering the
cognitive burden of the user", at least in the context of an input operation, should therefore
be at least potentially the subject of a patent. In other words a particular layout of
information, not specifying the nature of the content, should not be considered to be a
"presentation of information" in the sense of Article 52(2)(d) EPC
2.1.6 The board considers that a particular GUI layout could indeed shorten the search of
an inexperienced user for where or what data to enter. As a result, less computer
resources may be used. However, this reduction in use of resources would be caused by
the way the brain of the user perceives and processes the visual information given by a

The appellant is effectively arguing that there is a chain of effects: the improved
layout (which is indeed a "presentation of information" according to case law - see
below) "lowers the cognitive burden" for the user; the user therefore responds
more quickly; and the computer therefore requires less resources. But in terms of
technical effects this is a broken chain: the layout has an effect on the mind of the
user; a mental transition takes place more quickly than in the prior art; the user
responds more quickly, so that the computer uses less resources. Only the third of
these links can be called a technical effect, in that the user leaving the computer
idle for a shorter time than in the prior art reduces resource consumption

The board does not accept that such a broken chain can be used as evidence of
the required technical effect overall. It would seem that each of the links must be
technical in nature for such a chain argument to be persuasive. Thus, the appellant
has not established that there is an additional technical effect caused by the
improved layout: the layout produces a psychological effect on the user; the user
produces a technical effect on the computer. This is not the same as saying that
the layout produces a technical effect on the computer

Verfahren der elektronischen Datenverarbeitung sind im Hinblick auf § 1
Abs. 3 Nr. 3 PatG nur dann patentierbar, wenn sie der Lösung eines
konkreten technischen Problems mit technischen Mitteln dienen. Sie sind
vom Patentschutz ausgeschlossen, wenn sie losgelöst von einer konkreten
technischen Umsetzung beansprucht werden. Für mathematische
Methoden im Sinne von § 1 Abs. 3 Nr. 1 PatG gilt insoweit entsprechendes.
Das mit der Anmeldung beanspruchte Verfahren wird den sich daraus

Die Anwendung [mathematischer] Methoden zur Erzielung eines

c) Ein ausreichender Bezug zur gezielten Anwendung von Naturkräften

herangezogen wird, anhand von zur Verfügung stehenden Messwerten

European patent application No. 02250686.9 by Mark W. Perlin relates to a
method and a system for analysing a DNA sample that contains genetic
material from at least two individuals. Such analysis plays an important role in
forensic proceedings, in which, of course, the reliability of genotype
determination matters.

A method of this kind is already known from the earlier European patent
application No. 01301267.9 of the same applicant (= document D6), published
after the priority date of the application at issue and thus falling under Art. 54(3)
EPC, i.e. forming prior art for the requirement of novelty only.
The claimed method is distinguished from the earlier application by details of the
mathematical treatment of the data in the resolution step: in the linear matrix
equation already used in D6, an error vector which models measurement error
has been included (feature (i)), and the solution includes calculation of data
variance from the linear model together with the global minimal solution (feature
(ii)). New features (i) and (ii) thus relate to mathematical steps of errors
computation and evaluation.

First of all, the claimed subject-matter was found to be patent-eligible for the mere
reason that the amplification and quantifying steps were obviously performed using
dedicated laboratory equipment and devices, and therefore could not be considered as
being devoid of technical character. Hence, none of the claims of the request was
regarded as a non-invention pursuant to Art. 52(2) EPC.
With respect to the issue of novelty over document D6, the Board stated that it could be
argued that the above distinguishing features (i) and (ii) were of non-technical nature as
being a mathematical method or a method for performing mental activities and should be
ignored when assessing novelty, in analogy to the established case law, according to
which features that did not contribute to the technical character of an invention and did
not interact with the technical subject-matter of the claim for solving a technical problem,

In the present case, it had therefore to be examined whether or not the distinguishing
features made a technical contribution.
Since both the distinguishing features (i) and (ii) aimed at ascertaining the reliability of
the DNA analysis of samples containing genetic material from two or more individuals
and thus resulted in a quantitative estimate of the quality of the solution, the Board found
that the distinguishing features constituted a means for improving the confidence of the
genotype estimate of the quantitative method analysis of document D6. The Board
therefore considered that the distinguishing features contributed to the technical
character of the claimed invention.
In consequence, the Board considered that the distinguishing features had to be taken
into account when assessing novelty and concluded that the method of claim 1 was new

This appeal has returned to the court following an up and down journey to
and from the Supreme Court. In our original decision, we reversed the
district court’s holding that granted WildTangent … motion to dismiss
Ultramercial …, Inc.’s … patent infringement complaint.
The present posture of the case is that Ultramercial is again appealing from
the decision of the United States District Court for the Central District of
California. Upon review of the ’545 patent and the standards adopted by the
Supreme Court, for the reasons set forth below, we conclude that the ’545
patent does not claim patenteligible subject matter and accordingly affirm the
district court’s grant of WildTangent’s motion to dismiss.

Ultramercial owns the ’545 patent directed to a method for distributing
copyrighted media products over the Internet where the consumer receives a
copyrighted media product at no cost in exchange for viewing an
advertisement, and the advertiser pays for the copyrighted content.
The /Supreme/ Court in Alice made clear that a claim that is directed to an
abstract idea does not move into § 101 eligibility territory by “merely requir[ing]
generic computer implementation.”

In Alice, the Supreme Court identified a “framework for distinguishing patents
that claim laws of nature, natural phenomena, and abstract ideas from those
that claim patent-eligible applications of those concepts.” …“First, we determine
whether the claims at issue are directed to one of those patent-ineligible
concepts.” ... If not, the claims pass muster under § 101.
Then, in the second step, if we determine that the claims at issue are directed
to one of those patent-ineligible concepts, we must determine whether the
claims contain “an element or combination of elements that is ‘sufficient to
ensure that the patent in practice amounts to significantly more than a patent
upon the [ineligible concept] itself.’”

We agree with WildTangent that the claims of the ’545 patent are not directed to
patent-eligible subject matter. Following the framework set out in Alice, we first
“determine whether the claims at issue are directed to one of those patent-
ineligible concepts.”
As the Court stated in Alice, “[a]t some level, ‘all inventions . . . embody, use,
reflect, rest upon, or apply laws of nature, natural phenomena, or abstract ideas.’”
... We acknowledge this reality, and we do not purport to state that all claims in all
software-based patents will necessarily be directed to an abstract idea. Future
cases may turn out differently. But here, the ’545 claims are indeed directed to an
abstract idea, which is, as the district court found, a method of using advertising as
an exchange or currency

The second step in the analysis requires us to determine whether the claims do
significantly more than simply describe that abstract method. We must examine
the limitations of the claims to determine whether the claims contain an “inventive
concept” to “transform” the claimed abstract idea into patent-eligible subject
matter.
We conclude that the limitations of the ’545 claims do not transform the abstract
idea that they recite into patent-eligible subject matter because the claims simply
instruct the practitioner to implement the abstract idea with routine, conventional
activity.
The claims’ invocation of the Internet also adds no inventive concept. As we have
held, the use of the Internet is not sufficient to save otherwise abstract claims from
ineligibility under § 101

A claimed process can be patent-eligible under § 101 if: “(1) it is tied to a particular
machine or apparatus, or (2) it transforms a particular article into a different state
or thing.” … The claims of the ’545 patent, however, are not tied to any particular
novel machine or apparatus, only a general purpose computer.
And adding a computer to otherwise conventional steps does not make an
invention patent-eligible.
The claims of the ’545 patent also fail to satisfy the transformation prong of the
machine-or-transformation test.
Because the ’545 patent claims are directed to no more than a patent-ineligible
abstract idea, we conclude that the district court did not err in holding that the ’545
patent does not claim patent-eligible subject matter

1. The invention
The invention is a system for distributing audiovisual contents, eg movies,
containing advertisements by commercial sponsors to subscribers. After the
subscriber has chosen a movie to watch, a server selects appropriate
advertisements. The selection is made by adjusting the interests of three parties, viz
the subscriber, the content provider and the commercial sponsor. Attribute
information, characterizing the subscriber, the movie and the advertisements, is
compared with the corresponding requirements of the parties. The result of the

3.1 … it appears that the appellant sees the business aspect primarily in the fact that
the inserted data consists of advertisements. The examining division, on the other
hand, held that the entire selection procedure was as such nontechnical. The Board

The final selection of an appropriate advertisement requires the comparisons to be
combined to yield a single value. Claim 1 indicates that a weighted sum is
calculated … This mathematical rule will influence the selection. However,
advertisements differ only in their informational content, which is as such not
technical. The way the advertisements are inserted into the content is always the
same (and not even described), and therefore the rule has no technical effect.

3.5 It is finally noted that the advertisement selection could in principle be
performed mentally. Although it is not rare that the essential part of a technical
process can be so performed, a technical effect is normally only obtained when
the process is applied on a physical entity, such as a signal. The present invention
affects the information content of the signal but not the way it is represented. The
impact of the selection (besides any commercial advantage) is therefore solely on
the subscriber's mind.
3.6 For the reasons indicated the subject-matter of claim 1 does not does not

Following this analysis, it is my view that Nuijten’s claim 14 is directed to a new
and useful manufacture. Claim 14 is directed to a “manufacture” because the
signal is, in the broad sense discussed above, an “article,” “produc[ed] . . . for
use from raw or prepared materials by giving to these materials [a] new form[].”
See Chakrabarty, 447 U.S. at 308. Put differently, it is a product of human “art,”
or ingenuity; it is an application of technology to provoke some purposeful
transformation in the real world. Any contrary conclusion must depend on a too-
literal reading of either “article” or “material,” neither of which appears in the
statute, and neither of which any precedent—until today—has imposed as a
limitation on the otherwise “expansive” scope of § 101

1."Train d'impulsions élémentaires de défibrillation séparées par des pauses, train
constitué de la succession de cycles impulsion-pause provenant du découpage

(F) It is legitimate to have a mix of technical and "non-technical" features appearing in a claim, in which the non-technical features may even form a dominating part of the claimed subject matter. Novelty and inventive step, however, can be based only on technical features, which thus have to be clearly defined in the claim. (G) For the purpose of the problem-and-solution approach, the problem must be a technical problem which the skilled person in the particular technical field might be asked to solve at the relevant priority date. The technical problem may be formulated using an aim to be achieved in a non-technical field, and which is thus not part of the technical contribution provided by the invention to the prior art.   • 27. 18. Claim 1 of the main request defines a method for estimating sales activity of a product at a (non-reporting) sales outlet. The estimated sales activity is calculated essentially by correlating sales activities at reporting sales outlets according to the respective distance between the non-reporting sales outlet and the respective reporting sales outlet (see claim 1 and the WO publication, page 4, lines 33 ff. and page 8, lines 3 to 36, for example). Such a method is not an invention within the meaning of Article 52(1) to (3) EPC 22. Auxiliary request 1 explicitly claims technical means (processor) to perform individual steps of the method.   • 28. 10.13.1 …However, this does not mean that the list of subject-matters in Article 52(2) EPC (including in particular "programs for computers") has no effect on such claims. An elaborate system for taking that effect into account in the assessment of whether there is an inventive step has been developed, as laid out in T 154/04, Duns.   • 51. 2.1.5 … The appellant has argued that the reduction in the use of computer resources explained above is the required additional technical effect in the present case. The appellant further argues that any layout improvement which has the effect of "lowering the cognitive burden of the user", at least in the context of an input operation, should therefore be at least potentially the subject of a patent. In other words a particular layout of information, not specifying the nature of the content, should not be considered to be a "presentation of information" in the sense of Article 52(2)(d) EPC 2.1.6 The board considers that a particular GUI layout could indeed shorten the search of an inexperienced user for where or what data to enter. As a result, less computer resources may be used. But in terms of technical effects this is a broken chain: the layout has an effect on the mind of the user; a mental transition takes place more quickly than in the prior art; the user responds more quickly, so that the computer uses less resources. The claimed method is distinguished from the earlier application by details of the mathematical treatment of the data in the resolution step: in the linear matrix equation already used in D6, an error vector which models measurement error has been included (feature (i)), and the solution includes calculation of data variance from the linear model together with the global minimal solution (feature (ii)). New features (i) and (ii) thus relate to mathematical steps of errors computation and evaluation. First of all, the claimed subject-matter was found to be patent-eligible for the mere reason that the amplification and quantifying steps were obviously performed using dedicated laboratory equipment and devices, and therefore could not be considered as being devoid of technical character. Hence, none of the claims of the request was regarded as a non-invention pursuant to Art. 52(2) EPC. Since both the distinguishing features (i) and (ii) aimed at ascertaining the reliability of the DNA analysis of samples containing genetic material from two or more individuals and thus resulted in a quantitative estimate of the quality of the solution, the Board found that the distinguishing features constituted a means for improving the confidence of the genotype estimate of the quantitative method analysis of document D6. The Board therefore considered that the distinguishing features contributed to the technical character of the claimed invention. Upon review of the ’545 patent and the standards adopted by the Supreme Court, for the reasons set forth below, we conclude that the ’545 patent does not claim patenteligible subject matter and accordingly affirm the district court’s grant of WildTangent’s motion to dismiss.   • 69. We agree with WildTangent that the claims of the ’545 patent are not directed to patent-eligible subject matter. Following the framework set out in Alice, we first “determine whether the claims at issue are directed to one of those patent- ineligible concepts.” As the Court stated in Alice, “[a]t some level, ‘all inventions . . . embody, use, reflect, rest upon, or apply laws of nature, natural phenomena, or abstract ideas.’” ... We acknowledge this reality, and we do not purport to state that all claims in all software-based patents will necessarily be directed to an abstract idea. Future cases may turn out differently.   • 70. The second step in the analysis requires us to determine whether the claims do significantly more than simply describe that abstract method. We must examine the limitations of the claims to determine whether the claims contain an “inventive concept” to “transform” the claimed abstract idea into patent-eligible subject matter. We conclude that the limitations of the ’545 claims do not transform the abstract idea that they recite into patent-eligible subject matter because the claims simply instruct the practitioner to implement the abstract idea with routine, conventional activity. The claims’ invocation of the Internet also adds no inventive concept. A claimed process can be patent-eligible under § 101 if: “(1) it is tied to a particular machine or apparatus, or (2) it transforms a particular article into a different state or thing.” … The claims of the ’545 patent, however, are not tied to any particular novel machine or apparatus, only a general purpose computer. And adding a computer to otherwise conventional steps does not make an invention patent-eligible. The claims of the ’545 patent also fail to satisfy the transformation prong of the machine-or-transformation test. Attribute information, characterizing the subscriber, the movie and the advertisements, is compared with the corresponding requirements of the parties. The result of the comparisons determines which advertisements to insert 2. The prior art The hardware of claim 1 consists of connected terminals, databases and servers. The appellant acknowledges that these means are notorious. Claim 14 is directed to a “manufacture” because the signal is, in the broad sense discussed above, an “article,” “produc[ed] . . . for use from raw or prepared materials by giving to these materials [a] new form[].” See Chakrabarty, 447 U.S. at 308. Put differently, it is a product of human “art,” or ingenuity; it is an application of technology to provoke some purposeful transformation in the real world.
